How to Respond to a Minnesota Department of Commerce Complaint

Do Not Face A Complaint Alone!

Most licensees do not know where to turn when the Department of Commerce (DOC) opens an investigation. Responding to a DOC investigation or complaint requires an understanding of the rules and procedures governing these unique processes. Your best first step is to call us for guidance.

An investigation often begins with an interview and an examination of your complete file associated with the transaction. Unless it is resolved through negotiation, it will advance to a hearing before an administrative law judge, followed by the Commissioner's review of the judge's recommendation, and a potential court appeal of the Commissioner's final decision. We know the regulators, and they know us. A thorough and careful response at every stage of the proceeding will maximize your ability to protect both your license and your professional reputation.

REALTOR® Ethics Complaints and Procuring Cause Arbitrations

The Minnesota Association of REALTORS® (MNAR) is authorized to enforce the National Association of REALTOR® Code of Ethics and Standards of Practice, and to resolve procuring cause arbitrations. The penalty for Code violation can range from a simple warning letter, a fine of $15,000, or expulsion from MNAR, thereby terminating your Multiple Listing Service access. Procuring cause arbitrations can determine whether you retain, share or forfeit your commission.

It can be tempting to appear at the hearing alone - do not take that chance! If you have received an ethical practices complaint or demand for procuring cause arbitration, you need a professional with a solid understanding of the Code, and the ability to help you present your best case.

We proactively evaluate complaints and assemble the documents, evidence and explanations necessary to present your best case. Real estate licensee defense lawyer Wayne Gilbert is your best ally as you face the hearing panel composed of your fellow REALTORS® in an ethical practice or procuring cause complaint.
